What you agree to by using FileFreak, written to be read.

This is a draft. It describes how the service works today and has not yet been agreed as the legal text.

Your account

An account is for one person. You are responsible for what is done with it, so choose a password you use nowhere else and turn on a second factor in Settings.

The email address on the account has to be one you can read. It is how you are told about anything that affects your files or your bill.

Your files

What you upload stays yours. You give FileFreak permission to store it, to make the copies that storing it needs (a thumbnail, a smaller size of an image), and to deliver it to the people you choose to share it with. Nothing more.

A file is private until you say otherwise. A share link lets whoever holds the link open it. Making a file or a folder public lets anybody open it, and lists it on your public page. You can undo either at any time.

Something you put in the trash is kept for 30 days and then removed for good. Something you delete for good is gone.

What you may not store or share

  • Anything it is illegal to hold or to give to other people.
  • Other people's work that you have no right to share.
  • Software made to harm whoever opens it.
  • Anything meant to harass, threaten or defraud somebody.

You may not try to get around a limit, to reach files that are not yours, or to disrupt the service for other people.

Reports, and what is done about them

Anybody can report a public file, a share link, a post, a comment or an account, whether or not they are signed in. A person reads each report. A post or a comment that several people report is taken out of view until somebody has looked at it.

Where something breaks these terms, a post or a comment may be hidden, or the account may be suspended. A suspended account is told why by email and when it signs in. It can still sign in, download its files and delete them. Nothing of its is shown to anybody else, its share links and API keys stop working, and it can add nothing. You can answer through the support page.

Plans and paying

Free is free. It has limits (5 GB of storage, for one) and stops at them. It is never charged, and asks for no card.

Pro is a flat price, paid in advance, by the month or by the year. It includes an amount of storage, of downloads and of API calls. The pricing page states each amount and each rate, and what it states is what is enforced and charged.

What you use beyond what Pro includes is charged afterwards, for each calendar month, at the rates on the pricing page. Storage is charged on what you held on average across the month, not on the most you held at any moment.

You set the most the extras can cost in a month. When that limit is reached, uploads stop, and so do downloads and API calls beyond what Pro includes. Nothing is deleted. Raising the limit takes effect at once.

Payments are taken by Stripe. Your card details go to Stripe and never reach FileFreak.

Cancelling, and when Pro ends

You can cancel at any time in billing settings. Pro then lasts to the end of the period you have paid for, and the account moves to Free.

If the account then holds more than Free allows, it becomes read-only: you can download and delete, and cannot add. Nothing is removed for 30 days. During that time you are emailed more than once, and billing settings lists exactly what would be removed. After it, what is beyond the Free allowance is removed, starting with the trash and then the largest files. Going back to Pro, or making room, ends this at once.

The developer API

The developer API is part of Pro. An API key acts for you, so keep it where only your own programs can read it, and revoke one you think has been seen. What an app holds counts toward your account's allowance, and what it uses toward your bill.

When Pro ends, keys can only read for a time, so that a program can take its files elsewhere, and then stop working.

Leaving

You can delete your account in Settings. Your files are then removed from storage, your public page and your posts go, and your share links and keys stop. What is owed for the month in progress is charged first.

Still to be written

  • Who provides the service: the legal name and address of whoever runs FileFreak.
  • Refunds, and tax.
  • What the service is and is not liable for, and which country's law applies.
  • How these terms can change, and how much notice is given.
